PLEASE TAKE NOTICE that Defendant Minnesota Public Radio ("MPR"), through its undersigned attorneys, will bring the following motion on for hearing beforeRamsey County Court, 15 Kellogg Boulevard West, St. Paul, Minnesota 55102, at a date and time to be determined by the Court.

MOTION

Defendant Minnesota Public Radio moves this Court for an Order, pursuant to Minn. R. Civ. P. 12.02(e), dismissing the Amended Complaint with prejudice for failure to state a claim upon which relief can be granted. This motion to dismiss is based on the Amended Complaint, including its attachments, and the Memorandum in Support of Motion to Dismiss which is submitted herewith, together with a proposed Order.
